Terms and Conditions

These terms and conditions (from now on referred to as the “Terms and Conditions”) apply to all students of the Life Organizers Association of Japan (from now on referred to as the “Association”). In addition, this Terms of Use (from now on referred to as the “Terms of Use”) defines the rights and obligations of the Japan Association of Life Organizers (from now on referred to as the “Association”) concerning all courses sponsored by the Association. (from now on referred to as the “Association”).

Those who wish to enroll in a course are requested to read and fully understand the contents of the Terms and Conditions and to agree to the Terms and Conditions before applying for the course. You won’t be able to use this course if you disagree with these Terms and Conditions. Therefore, by applying for this course, you are deemed to have agreed to these Terms and Conditions.

Article 1 (Formation of Course Contract)

1. The contract of attendance for the Courses (from now on referred to as the “Contract of Attendance”) shall come into effect when the following conditions are met. The contract of attendance (from now on referred to as the “Contract of Attendance”) shall be formed between the Association, which sponsors the Courses, and the customer who applies for the Courses (from now on referred to as the “Applicant”) when the following conditions are fulfilled. (The applicant who becomes a party to the course contract after it is concluded is referred to as “the student”).

(1) The applicant has applied for the course by the application procedures stipulated by the organizer.
(2) The applicant has paid the course fee (from now on referred to as “course fee”) by the due date.
(3) The organizer has accepted the application after confirming the course capacity, course qualifications, and other necessary information.
(4) The applicant must have obtained the consent of a person with parental authority or another legal representative if the applicant is a minor.
(5) The applicant is not a member of organized crime groups, a quasi-constituent of organized crime groups, a person having a close relationship with them, or any other anti-social force.

2. If it is later found that the applicant does not meet the conditions stipulated in the preceding paragraph, the organizer may cancel the acceptance of the application in the prior section.

3. If the organizer does not accept the application for the course or cancels the acceptance, the applicant may receive a refund of the course fee already paid. However, the organizer may deduct the refund cost if the application is made after the deadline, if the applicant is not qualified for the course, or if there is any other reasonable reason.

Article 2 (Fees and Method of Payment)

1. Fees are determined separately for each course.
2. The following methods can pay fees.

Article 3 (Cancellation and Charges)

Applicants and students who have paid course fees may withdraw their application for a course contract or cancel a concluded course contract (from now on referred to as “Cancellation”) by paying the following cancellation fee. Cancellations shall be made only upon payment of the following cancellation fee. A method designated by the organizer shall make any notice of intent to cancel become effective when such notice of intent to cancel reaches the organizer.

(1) If the intention of cancellation is notified at least 3 days before the start of the course, 50% of the course fee will be charged as the cancellation fee.
(2) 70% of the course fee will be charged if the cancellation is made from 2 days to 24 hours before the start of the course.
(3) In the event of cancellation less than 24 hours before the start of the course, or in the event of absence without notice, 100% of the course fee will be charged, and the course fee will not be refunded.)

Article 6 (Cancellation of Course)

1. If the number of students does not reach the minimum number specified by the organizer, the organizer may cancel the course by appropriately notifying the students at least one week before the course date. In such a case, the organizer will refund all fees paid.
2. In the event of force majeure, natural disasters, inclement weather, or other force majeure that forces the cancellation or delay of a course, the organizer may postpone the route to a later date after the effects of such energy majeure have been resolved. Suppose the student incurs any damage due to such postponement (including the case where the student cannot attend the postponed date or is forced to leave the course early due to a delay in the end time). In that case, the organizer shall not be liable for any loss or damage incurred by the student. Likewise, the organizer shall not be responsible for any damage incurred by the participant due to such postponement.

Article 7 (Online Course)

1. When taking online courses, students shall comply with the following
(1) Students shall prepare the items instructed by the Association or the instructor in advance.
(2) Prior to taking online courses, students shall purchase the materials specified by the Association and confirm that they are free of typographical errors.
(3) The organizer shall not be liable for any disadvantages arising from failure to attend the required lectures (e.g., how to use online tools) prior to attending the online course. To be understood – the same shall apply in the case that the video is required to be viewed in advance.
(4) Students shall leave the classroom at the end of the class (unless otherwise approved by the Association or the instructor).
(5) The student must remain in the classroom until the end of the class.
(6) Students must identify themselves by their real names and show their faces when attending the class.
(7) Students must use a computer to take the class (unless otherwise approved by the Association or the instructor).
(8) Earphones or headsets must be used to facilitate communication between the lecturer and students as in a face-to-face lecture.
(9) Do not record, videotape, photograph, or download online lectures.
(10) To manage URLs, IDs, passwords, etc., for online lectures with the care of a good manager, and not to share them with third parties, disclose them to third parties, lend them, or transfer them.
(11)Only the applicant himself/herself may take the course.
(12) If a course deadline is set, the applicant must complete the procedures by that deadline.
(13) Not to transmit or post slanderous, obscene, violent, or other inappropriate content.
(14) Not to transmit or post harmful computer programs.
(15) Not to attempt to gain unauthorized access to networks or systems related to online courses or otherwise act in a manner that interferes with the Association’s operation.
(16) Not to place an appropriate burden on networks or systems related to online courses.
(17) Follow any other instructions given by the Association or the instructor. 2.

2. The tuition fee for the online course is the same as the tuition fee for the face-to-face course.
3. Fees for online courses shall be paid prior to enrollment in accordance with Article 1, Paragraph 1, Item 1.
4. the cost and procurement of internet connection environment, system, and other equipment and tools (writing materials, computers, tablet terminals, smartphones, earphones, headsets, etc.) necessary for attending online courses shall be borne by the student.
5. The Association shall not be liable for any obstacles to online course attendance due to malfunction of equipment, etc., or inadequate preparation of tools, as described in the preceding paragraph.

Article 8 (Completion of Course and Certification of Eligibility)

1. Only those who have completed the entire course curriculum and fulfilled the prescribed requirements shall be deemed to have completed the course.
2. In the case of a certification course, the certification will be granted only upon completion, passing an examination, payment of the certification fee, and fulfillment of other requirements as specified by the Association.

Article 9 (Ownership of Rights)

The copyright and all other rights to the textbooks and all other materials and information related to the course (from now on referred to as “the Association’s Content”) provided to students shall belong to the Association. The Association retains all copyrights and other rights to the texts and all other materials and information related to the course (from now on referred to as “Association Content”) provided to students. Students shall not use the Association Contents for any purpose other than taking the Courses without the prior written consent of the Association. They shall not reproduce, modify, translate, transfer, lend, distribute, or publicly transmit the Association Contents.

Article 10 (Confidentiality)

Students shall keep the contents of the Courses and any other technical or business information of the Association, as well as personal and private information of others, which they learn through attending the Courses, strictly confidential and shall not use, disclose or divulge such information to any third party.

Article 11 (Prohibited Matters)

1. Students shall refrain from engaging in any of the following activities.
(1) Solicitation of other students for multi-level marketing, network marketing, chain sales, religious activities, or other solicitation or business activities.
(2) Recording, videotaping, or photographing this course (unless otherwise permitted by the organizer).
(3) Commercial use of the Life Organizer Level 2 or Reuse Organizer Level 2 certifications (commercial use requires Life Organizer Level 1 certification and regular membership in the Association or Reuse Organizer Level 1 certification)
(4) Harassment or other disruptive behavior toward other participants
(5) False declarations to the organizer, acts contrary to the instructions of the organizer, or other acts that interfere with the operation of this course.
(6) Infringement on the Association’s copyrights, trademarks, or other intellectual property rights.
(7) Defaming, disgracing, or libeling the Association, lecturers, other students, other related parties, or any other acts that unreasonably interfere with the Association’s activities.
(8) Acts that are offensive to these Rules, laws, regulations, or public order and morals.
(9) Other acts deemed inappropriate by the organizer.

2. If a student violates any of the prohibitions in the preceding paragraph, the Association may revoke the student’s eligibility and accreditation. Even if a student’s eligibility or certification is canceled, the course fee will not be refunded. In addition, the Association may only accept future applications for the course from a student who has violated the prohibitions in the preceding paragraph.

Article 12 (Prohibition of Transfer)

Students may not transfer or allow a third party to inherit any rights (including but not limited to the right to take the course) under the Course Contract unless otherwise agreed to in writing by the Association. In addition, students may only transfer or allow a third party to inherit any rights under the course contract (including but not limited to the right to attend the course) if otherwise approved by the Association in writing.

Article 13 (Indemnification for Damages)

Students shall be liable for compensation for any damages caused to the Association, tutors, other students, or related parties due to violating these Terms of Use.

Article 14 (Non-warranty and Disclaimer)

1. Neither the Association nor the lecturers make any warranty, express or implied, as to the completeness, usefulness, accuracy, currency, or truthfulness of the Courses.
2. If a student suffers any damage due to reasons attributable to the organizer, the Association and the lecturers shall only be liable for compensation up to the actual course fees received for direct and ordinary damages that occurred, except in the case of intentional or gross negligence. They shall not be liable for indirect damages, special damages, incidental damages, or any other damages that are not covered by the organizer’s liability. Likewise, we shall not be responsible for indirect damages, special damages, incidental damages, or lost profits.

Article 15 (Revision of these Terms and Conditions)

The Association may revise these Terms and Conditions at any time as necessary. The revised Terms shall become effective when the Association publishes them on its website or in any other appropriate location.

Article 16 (Jurisdictional Agreement)

Any disputes regarding the Courses or these Terms and Conditions shall be subject to the exclusive jurisdiction of the district court having jurisdiction over the principal office or business address of the Sponsor as the court of first instance.
